At Navigator TMS, LLC (hereinafter “NAV” or “we”), we respect your need for online privacy and use reasonable efforts to protect any Personal Information that you may share with us. Our practice with respect to use of your name, email address, phone number and other personally-identifiable information you share with us (“Personal Information”) is as set forth in this Privacy Policy. By registering for or using the NAV Services (“Services”), you consent to the terms of the Privacy Policy as it may be updated from time to time. This Privacy Policy applies exclusively to www.navigatortms.com.

We may modify this Privacy Policy upon notice to you at any time through a service announcement or by sending email to your primary email address. If we make significant changes to this Privacy Policy that affect your rights or our use of your Personal Information, you will be provided with at least 30 days' advance notice of the changes by email to your primary email address.

NAV does not knowingly collect Personal Information from users who are under 13 years of age.

Personal Information

During the Registration Process for creating a company or user account, we request for your name, email address and phone number. These will be treated as your Personal Information.

You will also be asked to choose a unique username and a password, which will be used solely for the purpose of providing access to your user account. Please note that your username is not Personal Information, even if it is related to your real name.
You should select your username accordingly.

Your name and email address will be used to inform you regarding new services, releases, upcoming events and changes in this Privacy Policy Statement. Your phone number is used when you access the mobile app related to the Services.

NAV will have access to certain additional information provided by you as part of using NAV Services, such as the location of your mobile device when the mobile app is activated, and the telecommunications carrier you use with your mobile device. This additional information may also include third party names, email addresses, phone numbers and physical addresses, and will be used by us to provide the Services to you. We do not share your Personal Information with anyone for promotional purposes, nor do we utilize it for any purposes not associated with the Services unless you expressly consent otherwise.

When you elect to refer friends to the website, we request their email address and name to facilitate the request and deliver a one-time email. Your friend may contact us at support@freightexchangenetwork.com to request that we remove this information from our database.

We post user testimonials on our website. These testimonials may include names and other Personal Information and we acquire permission from our users prior to posting these on our website. NAV is not responsible for the Personal Information users elect to post within their testimonials.

Usage Details

Your usage details such as time, frequency, duration and pattern of use, location and route information, features used and the amount of storage used will be recorded by us in order to enhance your experience of the NAV Services and to help us provide you the best possible service.

Contents of your User Account

We store and maintain data, files, documents, and other data stored in your user account within a cloud-computing environment. We may use third-party data and hosting providers to provider, operate and maintain the cloud environment, but we will maintain control over the Personal Information associated with your account. In order to prevent loss of data due to errors or system failures, we also keep backup copies of data including the contents of your user account. Hence, your files and data may remain on our servers and third-party servers even after deletion or termination of your user account.

We may retain, use and disclose your Personal Information and data as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our rights. Unless otherwise required by law, regulation, or court order, we take commercially reasonable steps to keep the contents of your user account private, and do not disclose it to anyone (even to employees of NAV) except in circumstances specifically mentioned in this Privacy Policy and the Terms of Services.

Payment Information

In case of services requiring payment, we request credit card or other payment account information, which will be used solely for processing payments. NAV does not store or record confidential payment information in our systems. All information is sent and managed by our third-party payment provider, which is currently Stripe.com. You should review the Stripe.com terms, including its privacy policy, at https://stripe.com. We may change our payment processor from time to time, and we will post the information for our then-current processor here. Your financial information will not be stored by us except for the name and address of the card holder. Subject to your prior consent and where necessary for processing future payments, your financial information will be stored in encrypted form with our payment provider and in accordance with this Privacy Policy. Visitor Details

We use the Internet Protocol address, browser type, browser language, referring URL, files accessed, errors generated, time zone, operating system and other visitor details collected in our log files to analyze the trends, administer the website, track visitor’s movements and to improve our website. We link this automatically collected data to other information we collect about you. We may use this data and information in our discretion, including to improve the Services and create new offerings. We may also share this data and information with third parties, provided that we will not disclose your usage details to a third party in a way that can be associated with your Personal Information.
